Description

The Roseau Magistrate's Court serves as a central institution in Dominica's judicial system. It is located on the Bayfront in the capital, Roseau, within Saint George Parish. It is a key venue for the administration of local justice and the hearing of summary and preliminary matters, forming part of the lower judiciary that handles most of the country’s criminal and civil caseloads. The court is situated near key government offices, within walking distance of the High Court of Justice, the Parliament Building, and the Registry Division.

Jurisdiction and Functions

The Magistrate’s Court deals primarily with:

  • Criminal matters that fall under summary jurisdiction
  • Preliminary inquiries for indictable offences
  • Family and civil matters such as maintenance, protection orders, and landlord-tenant disputes
  • Traffic violations and minor offenses

Magistrates preside without juries and often serve as the first point of contact for legal proceedings before cases escalate to the High Court.

Role in the Judicial System

As part of the wider Eastern Caribbean Supreme Court framework, the Roseau Magistrate’s Court operates under the guidance of the Attorney General of Dominica and in accordance with the Dominica Constitution Order. The court supports judicial efficiency and access to justice, especially for communities in and around Roseau, Newtown, and adjacent districts.

Often the busiest court on the island, it is integral to maintaining public order, enforcing local laws—including those under the Public Order ActBail Act, and Criminal Procedure Act—and protecting community welfare through the resolution of disputes.
